1. Our content
The text, design, graphics, logos and code of eleventhbit.com belong to ELEVENTHBIT R&D COMPANY LLC or are used under license. You may view and print pages for your own reference. You may not copy, republish or sell our content, or use the EleventhBit name or logo, without our written permission.
2. Your content
Manuscripts, data, figures, text, images and logos you send us remain yours. When you send us material, you confirm that you own it or have permission to use it, and that our using it to deliver your order will not infringe anyone's rights. Ownership of the work we deliver is set out in section 9 of our Terms & Conditions. We do not knowingly edit, reproduce or publish material that infringes someone else's copyright.
3. Reporting copyright infringement
If you believe material on our website, or on a website or app we have built for a client, infringes your copyright, send a written notice to our copyright agent (section 7) that includes:
- your physical or electronic signature, as the copyright owner or a person authorized to act for them;
- a description of the copyrighted work you believe has been infringed;
- a description of the material you believe is infringing and where it is located, such as the page URL;
- your name, address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for them.
When we receive a complete notice, we will remove or disable access to the material promptly and, where we can, tell the person who supplied it.
4. Counter-notification
If material you supplied was removed and you believe that was a mistake or misidentification, you may send a counter-notification to our copyright agent that includes:
- your physical or electronic signature;
- a description of the material that was removed and where it appeared before removal;
- a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- your name, address and telephone number; and
- a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice.
We will forward a valid counter-notification to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action, we may restore the material within 10 to 14 business days of receiving the counter-notification.
5. Repeat infringement
We may decline or end work for a client who repeatedly supplies infringing material, in line with section 15 of our Terms & Conditions.
6. False claims
Under 17 U.S.C. § 512(f), anyone who knowingly makes a materially false claim in a notice or counter-notification may be liable for damages. If you are not sure whether material infringes your copyright, consider getting legal advice before sending a notice.
